Position Overview:
The Senior Counsel supporting the Government Operations business segment at BWXT will rotate through and be available to assist the Nuclear Operations Group (“NOG”), Nuclear Fuel Services (“NFS) and Technical Services Group (“TSG”) business lines and will be a key legal advisor responsible for providing comprehensive legal support across those various business units. Counsel will develop familiarity with each of the referenced business lines legal operations and needs, will and provide necessary volume and subject matter support to any/all those business lines. This position requires an attorney experienced in representing Federal Government contractors and able to engage in proposal analysis and preparation, negotiation and interpretation of project and business-related contracts, contract enforcement during and after project execution, claim development and defense, assistance with project related dispute resolution, labor negotiations, compliance investigation and general business line legal support.  Counsel will provide legal guidance, counsel and support to all levels of operating business line management including senior Government Operations executives and project management personnel as well as BWXT Deputy General Counsel. This position will involve rotation through three Government Operations business line legal departments.

 

Location:

Onsite in Lynchburg, VA, Cleveland, OH, Charlotte, NC or Tysons, VA. Relocation available. Involves domestic travel to various business facilities.

 

 

Your Day to Day as a Government Operations Flex Counsel

  • Advise company officials and employees on contractual matters both on commercial and U.S. Government contracts with a greater emphasis on the latter.  Review and formally concur on major contract actions taken by the company.
  • Represent the company before Panels and Boards related to Federal Government Contract Compliance matters and maintain current knowledge on the Federal Acquisition Regulations (FAR) and Agency supplements to the FAR.  Review contract documents and company purchasing procedures for compliance with the pertinent regulations.
  • Assist with project proposal preparation and review and potential post- award protest.
  • Assist with labor negotiations with various unions for various facilities.
  • Advise the company on environmental matters and potentially represent the company before regulatory forums on certain environmental issues.
  • Assist with Corporate Ethics and Compliance investigations arising out of ethics and compliance hotline calls, employee reporting through the management chain or at the request of the Government or other customers. Prepare formal reports when required by Government and non-government customers.
  • Manage/assist with litigation including budget, providing ongoing communication to clients and the legal department and developing strategies for the litigation and the potential for settlement.
  • Prepare and present relevant training to company personnel.
  • Ensure proper and timely legal advice is provided to any business level or function to achieve business objectives while limiting legal risk and/or liability.
  • Provide and supervise legal reviews of various contracts and contract deviation approvals.
  • Lead/support contract negotiations, development and negotiation of contracts, and legal documentation to support business objectives.
  • Manage and support dispute, litigation and settlement strategy and execution and supervise outside legal services in support thereof.
  • Support project specific entity formation and organization.
  • Implement and enforce corporate policies and procedures.
  • Support management in understanding, advancing and protecting the organization in legal matters.

Required Minimum Qualifications:

  • At least 10 years of experience which includes extensive complex federal government engineering and/or equipment manufacturing contracting, execution and claims experience and/or compliance.
  • Juris Doctor degree from an accredited law school.
  • Current active status in at least one State Bar as certified by the Supreme Court of the licensing jurisdiction. 
  • Must be a U.S. citizen
  • Must be able to obtain and maintain an U.S. DOE clearance

Pay: $207,000 - $271,000

 

The base salary range for this position in Virginia (US-VA) at the start of employment is expected to be between $207,000 and $271,000 per year. However, the base salary offered is based on local job market factors, and may vary further depending on factors specific to the selected job candidate, such as job-related knowledge, skills, experience, and other objective business considerations. Subject to these considerations, the total compensation package for this position may also include other elements, such as an annual cash incentive in addition to a full range of medical, retirement, and/or other benefits. Details of participation in these benefit plans will be provided at such time the selected job candidate receives an offer of employment. If hired, the selected job candidate will be employed 'at-will,’ unless employed at a location and in a position subject to a collective bargaining agreement.  The company further reserves the right to modify base salary (as well as any other discretionary payment, compensation or benefit program) at any time, including for reasons related to individual performance, company or individual department/team performance, and other market factors.
